Liability In Dannemora Motorcycle Accidents

In 2019 over 5,000 motorcyclists were killed in car accidents according to one report from the NHTSA. By their very nature motorcycles are far less crashworthy than enclosed vehicles. They are also much more likely to be overlooked due to their small size. Motorcyclists must drive extremely well to stay safe. They would also do well to drive defensively and take into consideration how inept other drivers can be. Factors that could potentially influence the likelihood of a car accident will include:

  • Speeding
  • Distracted driving
  • Inclement weather
  • Dangerous left turns

Every driver in New York is legally obligated to exercise due care to avoid collisions. According to New York Vehicle & Traffic Law § 1141, the driver of a vehicle intending to turn left shall yield the right of way to any oncoming vehicle approaching from the opposite direction close enough to pose a hazard. Drivers that make unprotected left turns will typically be held at fault in the event of a collision. There are a number of steps that should be taken following any motorcycle accident.

  • Eye witnesses should be interviewed
  • Surveillance footage should be sought
  • Medical records should be preserved
  • An experienced motorcycle accident attorney should be consulted

Dealing with the aftermath of a motorcycle accident can be extremely difficult in the best of circumstances. It’s not uncommon for victims to face high medical bills and accrue months of lost time from work. Victims of motorcycle accidents may be able to seek justice through  a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A motorcycle accident attorney can examine the unique facts of your case free of cost and fight to get you the medical and financial support you deserve.
