Liability In Brooklyn Hit-And-Run Collisions

Thousands of people are seriously injured or killed in hit-and-run collisions every year. According to AAA, there were over 700,000 hit-and-run collisions in 2015 alone. That results in nearly one hit-and-run collision every 43 seconds in the United States. Speed and alcohol are two of the most common contributing factors for hit-and-run collisions. But there are a number of other factors that could potentially contribute to a crash.

  • Driver fatigue
  • Driver distraction
  • Inclement weather
  • Poor road design
  • Vehicle malfunctions

Drivers that flee the scene of collisions that result in bodily injury or death can be held responsible through a criminal claim. They can also be held accountable through a civil claim. According to New York Vehicle & Traffic Law § 1180(a), “No person shall drive a vehicle at a speed greater than is reasonable and prudent under the conditions and having regard to the actual and potential hazards then existing.” When a driver fails to yield and strikes a pedestrian, they could be liable through a bodily injury claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Spinal cord injuries
  • Lacerations

Any person that is injured due to the negligence of another driver can seek aid through a civil claim. Damages can help cover lost wages, medical bills and pain and suffering. Many accident victims may not realize the full extent of their injuries for several months or years after a collision. A New York City pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
