BRONX, NEW YORK (August 16, 2022) – A woman identified as Donna Douglas was killed in a Bronx accident involving a falling tree at the River Terrace Apartments.

New York City police officials are saying that the accident took place around 1:30 p.m. on Monday. Donna Douglas was in the pool at the River Terrace Apartments when she was hit on the head by a large tree.

Liability In Bronx Tree Fall Accidents

Thousands of people are seriously injured every year in accidents involving falling trees. In fact, nearly 100 people are killed every year in the U.S. after being hit by falling trees. While these accidents may seem like freak occurrences, they are often highly predictable. There are a number of signs which can indicate that a tree is likely to fall over.

  • A tree may have an unusual amount of dead or falling branches.
  • A tree may have missing bark or deep marks.
  • A tree may have fungus on the roots.
  • A tree may have raised soil near the base.

A property owner could potentially be liable for any accident where a person is hit by a falling tree. Property owners have an obligation to maintain their premises in a reasonably safe condition. When a property owner has actual or constructive notice of a dangerous condition on their property, they must take action to correct this dangerous condition.

One way that property owners can protect residents and guests from falling trees is by having the trees on the property periodically inspected by arborists.  If a property owner was not inspecting the trees on their property and a tree was in a dangerous condition, this could form the basis of a negligence claim. There are a number of steps that should be taken after any accident involving a falling tree.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • The tree that fell should be inspected by an arborist.
  • A thorough, independent investigation should be conducted.

The family of any victim that died in a car accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, property owners will often fight very hard to deny liability for any  accident involving a falling tree. This is why it is so important that evidence is properly preserved after any time a free falls over.
