Liability In Yorkville Motorcycle Accidents

Motorcyclists are uniquely vulnerable in car accidents. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to the Insurance Information Institute, “In 2019, 5,014 motorcyclists died in motorcycle crashes, down slightly from 5,038 in 2018, according to the National Highway Traffic Safety Administration (NHTSA). In 2019, motorcyclists were nearly 29 times more likely than passenger car occupants to die in a crash per vehicle miles traveled.” There are a number of steps that drivers should take in order to avoid hitting motorcyclists.

  • Drivers should check their blind spots.
  • Drivers should reduce their speed during times of low visibility.
  • Drivers should maintain a safe follow distance behind motorcyclists.

Every driver has a legal obligation to exercise due care in order to avoid hitting other vehicles. Many collisions are due to drivers that make dangerous left turns. Pursuant to New York Vehicle Code § 1141, the driver of any vehicle intending to turn left within an intersection into an alley or private road must first yield the right of way to any vehicle traveling from the opposite direction close enough so as to pose a hazard. Victims of motorcycle accidents tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Organ damage
  • PTSD

Any person that is injured in a motorcycle accident may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. It is important that accident victims continue to seek medical treatment after any accident. Many victims may not fully realize the extent of their injuries until some time after a collision. A car accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
