Liability In Brooklyn Hit-And-Run Car Accidents

Thousands of people are killed or seriously injured every year with hit-and-run drivers. According to one report by Value Penguin, “Americans traveled nearly 31 trillion miles collectively from 2010 to 2019. For every 10 billion miles traveled, there were 5.5 fatal hit-and-runs across the U.S. In the same period, these hit-and-run crashes resulted in 17,531 deaths.” The vast majority of these collisions were due to human error and could have been prevented. Some of the most common contributing factors for hit-and-run collisions are.

  • Speeding
  • Reckless driving
  • Driver fatigue
  • Dangerous turns

All drivers have a legal responsibility to exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. Bicyclists have a naturally small profile and are therefore more likely to be overlooked in collisions. When a driver flees the scene of any collision that results in bodily injury or harm they could face criminal as well as civil liability. There are a number of steps that should be taken after any hit-and-run collision.

  • Fragments of the fleeing vehicle should be sought.
  • Surveillance footage should be sought.
  • Photos of the accident site should be taken.
  • It should be determined if there is a history of collisions along the road in question.

Any person that is injured in a car accident may be able to seek justice through a bodily injury claim. Damages can help cover lost wages, medical bills and pain and suffering. A bicycle accident attorney can examine all of the facts of your case and let you know what your legal options are. An attorney can determine if you have a valid claim that can be pursued.
