Liability In Wheatfield Dump Truck Accidents
Dump trucks can be particularly dangerous to bicyclists for many reasons. They have large blind spots that can easily obscure the presence of pedestrians and bicyclists. According to the Engineering News-Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” There are a number of steps that dump truck drivers should take in order to avoid hitting bicyclists.
- Dump truck drivers should check their blind spots before making turns.
- Dump truck drivers should continuously scan the road ahead of them for potential hazards.
- Dump truck drivers should abstain from alcohol and other intoxicating substances.
Dump truck drivers will typically need to get a commercial license and are held to a high standard in terms of safety. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. When a dump truck driver fails to exercise due care and hits a bicyclist, this could form the basis of a negligence claim.
If a dump truck driver was working at the time of a collision, the company that they were working for could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a dump truck driver may have been transporting materials when they were involved in a crash. There are a number of steps that should be taken after a dump truck accident.
- Eye witnesses should be interviewed.
- Surveillance footage should be sought.
- Medical records should be preserved.
- A thorough, independent investigation should be conducted.
The family of any person that is killed in a dump truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover many of the unexpected expenses that come with the sudden loss of a loved one. Sadly, truck companies will often fight extremely hard to deny liability for any collision. This is why it is so important that evidence is properly preserved after any collision.
