BROOKLYN, NEW YORK (August 16, 2022) – A delivery worker identified as Daniel Vidal died in a Brooklyn truck accident by Morgan Avenue and Meadow Street.

Despite life-saving measures, Daniel Vidal died at the hospital. A full investigation into the crash remains ongoing at this time.

Liability In Brooklyn Truck Accidents

New York City has proven to be a hazardous place for motorcyclists. Gig workers can have it particularly bad. According to one report by the New York Times, at least 50 people have been killed while doing gig driving since 2017. Trucks can be particularly dangerous for a number of reasons.

  • Trucks have large blind spots that can obscure the presence of smaller vehicles.
  • Trucks take much longer to stop than passenger vehicles.
  • Truck drivers often work long hours and it is common for them to become dangerously fatigued.

Truck drivers will typically need to get a commercial driver’s license and are held to a high standard in terms of safety. Many accidents are caused by truck drivers that make dangerous left turns. Pursuant to New York Vehicle & Traffic Law § 1163, “No person shall turn a vehicle at an intersection […] or move right or left upon a roadway unless and until such movement can be made with reasonable safety.” If a truck driver fails to take steps to avoid hitting a motorcyclist, this could form the basis of  a negligence claim.

Depending on the facts of any case, the company that a truck driver worked for could potentially be held at fault for a collision. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a truck driver may have been delivering packages when a crash occured. Victims of truck accidents tend to suffer very serious and costly injuries.

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries
  • Organ damage

The family of any victim that died in a truck accident may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. Sadly, though, truck companies will often fight extremely hard to deny liability for any crash. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
