Liability For Long Beach Scaffold Accidents
Falls remain one of the leading causes of workplace injury and death in the construction industry. Scaffolds can be particularly hazardous. According to the United States Bureau of Labor Statistics (BLS), around 60 people are killed and another 4,500 people are injured every year in scaffold accidents. The vast majority of scaffold accidents are totally preventable. There are a number of steps that construction companies should take in order to prevent scaffold accidents.
- Workers should be given proper safety equipment.
- Scaffolds should never be loaded past their intended load limits.
- Scaffolds should be regularly inspected for safety.
- Workers should have access to personal fall arrest systems.
Property owners and general contractors are held strictly liable for gravity related accidents under New York State Labor Law § 240/241, commonly referred to as the scaffold law. This includes accidents where a worker falls or is struck by a falling object. There are, however, restrictions for when the statute would be applicable. A worker would need to be performing a qualifying task including the “erection, demolition, repairing, altering, painting, cleaning or pointing of a building.” There are a number of steps that should be taken after a scaffold accident.
- Eye witnesses should be interviewed.
- The scaffold involved in the accident should be inspected.
- Safety records for the construction site should be reviewed.
- An experienced construction accident attorney should be consulted.
Victims of scaffold accidents tend to suffer very serious and costly injuries. Many workers may not be able to return to work for significant periods of time. Any person that is injured in a scaffold accident may be able to seek aid through a personal injury claim.
