Liability In Greenvale Landscaping Truck Accidents
Thousands of people are killed or seriously injured every year in truck accidents. According to the Insurance Institute for Highway Safety (IIHS), “A total of 4,014 people died in large truck crashes in 2020. Fifteen percent of these deaths were truck occupants, 68 percent were occupants of cars and other passenger vehicles, and 16 percent were pedestrians, bicyclists or motorcyclists.” The vast majority of truck accidents are preventable and involve some amount of human error. There are a number of steps that truck drivers should take in order to avoid collisions.
- Truck drivers should always scan the road ahead of them for potential hazards.
- Truck drivers should be well rested before the start of their shift.
- Truck drivers should abstain from alcohol and other intoxicating substances.
All truck drivers have a legal obligation to exercise due care in order to avoid causing accidents. Many accidents are caused by drivers that make dangerous turns. Pursuant to New York Vehicle & Traffic Law § 1163, “No person shall turn a vehicle at an intersection […] or move right or left upon a roadway unless and until such movement can be made with reasonable safety.” If a truck driver makes a turn in front of another vehicle prior to a crash, this could form the basis of a negligence claim.
The company that employed a truck driver could also be held at fault for a crash. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. For example, a truck driver may have been delivering materials at the time of a crash. There are a number of steps that should be taken after any truck accident.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
- Photos of the accident site should be taken.
- A thorough, independent investigation should be conducted.
The family of any victim that died in a truck accident may have legal recourse through a wrongful death claim. Potential beneficiaries in a civil claim will typically include a victim’s spouse and children. Sadly, truck companies will often fight hard to deny responsibility for any accident. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
