Liability In Chenango County Sexual Assaults

Sexual assaults in the school setting are far more common than many people may realize. According to one report by Politico, “Schools reported nearly 15,000 total incidents of sexual violence in the 2017-18 school year, a 55-percent increase from the 2015-16 school year.” Sadly, many instances of sexual assault or sexual harassment go unreported. Sexual harassments or sexual assault can come in many different forms:

  • Attempted rape
  • Unwanted touching or sexual contact
  • Solicitation of minors
  • Unwanted sexual advances

School officials have a legal obligation to keep students safe. This includes taking measures to protect students from sexual assault. As explained in Mirand v City of New York, “Schools are under a duty to adequately supervise the students in their charge and they will be held liable for foreseeable injuries proximately related to the absence of adequate supervision.” When a school district fails to take measures to adequately protect students, it could be liable through a civil claim. There are a number of steps that school district can take to protect children from sexual abuse:

  • School officials should be trained to look for signs of sexual abuse in kids.
  • School officials should properly monitor all faculty.
  • School districts must properly vet prospective employees.

The family of any child that was abused by a school official may be able to seek some measure of justice through a civil claim. Sexual assaults are no small matter. They can profoundly impact the psychological health and development of children. Victims of sexual assaults are more prone to PTSD, anxiety, and suicidal ideations. A New York sexual abuse attorney can examine all of the unique facts of your case and let you know what your legal options are.
