Liability For Brooklyn Bicycle Accidents

According to one report from the Insurance Institute for Highway Safety (IIHS), “around 2% of all of the fatal collisions that take place every year involve bicyclists. The most serious injuries that occur are head injuries, which highlights the importance of wearing a helmet.” About 65% of bicycle accidents occurred on major roads. In New York City, the vast majority of collisions occur on a relatively small number of roads and intersections. Factors that could influence the likelihood of a collision could include:

  • Poor road conditions
  • Driver distraction
  • Dangerous turns
  • Speeding

All drivers have a legal obligation to exercise due care in order to avoid hitting bicyclists under New York Vehicle & Traffic Law § 1146(a). The major problem with commercial trucks is that they have large blind spots. It is common for truck drivers to turn into the path of bicyclists because they did not see them. If a truck driver fails to exercise due care and hits a bicyclist, this could form the basis of a negligence claim. Their employer could also be held at fault. There are a number of steps that should be taken after any semi-truck accident.

  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • A thorough investigation should be conducted.

If a truck driver was working at the time of a collision, the company that they were working for could be held at fault. The family of any person that is killed in a truck accident may have legal recourse through a civil claim. Damages in a civil claim can help with many of the expenses that come with the sudden loss of a loved one. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are.
