Child Injured In New Rochelle Apartment Fall Accident

NEW ROCHELLE, NEW YORK (July 12, 2022) – A 4-year-old child was critically injured after falling from an apartment window in New Rochelle near Fifth Street and Union Avenue.

New Rochelle police officials are saying that the accident took place on Friday evening. A child fell from the Hudson Valley apartment window under unclear circumstances.

The child’s parents first called police because the child was missing. Eventually the child was found and paramedics began performing life-saving measures.

First responders took the child to the hospital with critical injuries. A full investigation remains ongoing at this time.

Liability In New Rochelle Apartment Fall Accidents

Falls are one of the main causes of serious injury and death for small children. According to one report from the Stanford Children’s Hospital, “It is estimated that more than 2.2 million children ages 14 and under are treated annually at hospital emergency rooms for fall-related injuries. More than half of fall-related injuries among children occur among ages 4 and under.” There are a number of steps that can be taken to prevent window fall accidents.

  • Apartments should be properly maintained.
  • Apartment windows may need window guards.
  • Furniture should be kept away from windows.

Property owners have a legal obligation to maintain their premises in a reasonably safe condition. In general, property owners must install window guards on apartments when there is a child 10 years of age or younger in the residence or when the resident requests guards. If a property owner fails to install window guards in a unit with a child, this could form the basis of a negligence claim. Victims of window falls tend to suffer very serious and costly injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The family of any child that is injured in an apartment fall may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover medical bills and pain and suffering. Sadly, though, property owners will often fight hard to deny liability for any accident. A premises liability attorney can examine all of the facts of your case and let you know what your legal options are.
