Child Injured In Brooklyn Ice Cream Truck Accident on Hendrix Street

BROOKLYN, NEW YORK (June 29, 2022) -A 4-year-old boy was critically injured in a Brooklyn ice cream truck accident along Hendrix Street in East New York.

New York City police officials are saying that the accident took place around 6:45 p.m. on Friday. A 4-year-old boy was riding a bicycle when he was struck by an ice cream truck.

Firefighters and paramedics were called to the scene of the collision in order to help the victim. The boy was taken to the hospital with serious injuries.

Police arrested the driver of the ice cream truck for driving on a suspended license.

Liability In Brooklyn Ice Cream Truck Accidents

Thousands of bicyclists are killed or seriously injured every year in the United States. According to the Centers for Disease Control, “Bicycle trips make up only 1% of all trips in the United States. However, bicyclists account for over 2% of people who die in a crash involving a motor vehicle on our nation’s roads. Nearly 1,000 bicyclists die and over 130,000 are injured in crashes that occur on roads in the United States every year.” Ice cream trucks can be particularly dangerous to children for a number of reasons.

  • Ice cream trucks lure small children through busy roads with their siren songs and promises of sweet treats.
  • Ice cream trucks have large blind spots that can obscure the presence of small children.
  • Ice cream trucks can weigh well over 10,000 lbs. Even a low speed collision can lead to catastrophic injuries.

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. When a driver fails to exercise due care and causes an accident, they can be held at fault through a civil claim. Their employer could also potentially be held at fault for the accident. This is especially true if their employee did not have the proper license or certification to drive a truck. There are a number of steps that should be taken after any pedestrian accident.

  • Eye witnesses should be interviewed.
  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • A thorough, independent investigation should be conducted.

Any person that is injured due to the negligence of another driver may have legal recourse through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. Sadly, though, many drivers will often fight hard to deny liability for any collision. A car accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
