Brian Harper Killed, James Fox Injured In Guilderland Amazon Truck Accident On Interstate 90

GUILDERLAND, NEW YORK (April 7, 2022) – A man identified as Brian Harper has died and multiple people including James Fox, Samantha Bonanno, Amanda Clark and Anthony Squillo were injured in an Amazon truck accident on Interstate 90.

Albany County police officials are saying that the accident took place  around 8:00 a.m. on Wednesday. A 53-year-old Amazon truck driver was going eastbound on Interstate 90 when traffic began to slow.

The truck driver was unable to slow down and hit a car driven by Brian Harper. That Amazon truck proceeded to hit several other vehicles which injured numerous people including James Fox, Samantha Bonanno, Amanda Clark and Anthony Squillo.

Firefighters and paramedics were called to the scene of the accident in order to help all of the victims.  The force of the impact caused several vehicles to catch fire.

Despite life-saving measures, Brian Harper died due to his injuries. James Fox, Samantha Bonanno, Amanda Clark and Anthony Squillo were all taken to the hospital in order to receive treatment. One other person reportedly died, though they have not been identified at this time.

The driver of the Amazon semi-truck was taken to a state police barracks in Latham where he was evaluated by a Drug Recognition Expert (DRE). A full investigation into the crash remains ongoing.

Liability In New York Amazon Truck Accidents

Amazon has become ubiquitous in the United States and across the globe. One of the reasons for Amazon’s success is its incredible distribution network that allows customers to receive their products at record speeds. But this has also come at a heavy cost. Many people have died or been seriously injured in crashes with amazon trucks. According to one report in the NY Times, “The retail giant directs the destinations, deadlines and routes for its network of contract delivery drivers. But when they crash, Amazon is held harmless.” There are a number of factors that could potentially contribute to an Amazon truck accident.

  • Speeding
  • Distracted driving
  • Inclement weather
  • Driver intoxication
  • Inadequate driver training

Depending on the facts of any case, there could be numerous liable parties for a truck accident. Truck drivers must exercise due care to avoid collisions and could be liable for their negligent actions. Pursuant to New York Vehicle Code § 1180, no person shall drive a motor vehicle at a speed than would be reasonable or safe given the prevailing conditions of the roadway. There is simply no reason a driver should ever rear-end another vehicle in their own lane. Indeed, there is a rebuttable presumption of negligence on the part of any driver that rear-ends another vehicle.

If the driver of a truck was negligent and causes an accident, the company that they work for could potentially be held at fault. Generally speaking, companies are liable for the negligent actions of their employees – insofar as those employees were working within the course and scope of their job duties. However, Amazon often tries to evade liability for collisions by hiring their drivers as “independent contractors.” There are reports that Amazon pushes its delivery drivers with unrealistic and dangerous demands for package delivery. There are a number of steps that should be taken after any truck accident.

  • Photos of the accident site should be taken.
  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • A thorough, independent investigation should be conducted.

The family of any victim that died in an Amazon truck accident may have legal recourse through a wrongful death claim. Damages can help cover lost wages, medical bills and funeral expenses. Sadly, though, Amazon will fight hard to deny responsibility for any truck accident. A wrongful death attorney can examine all of the unique facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims.
