They can be held legally responsible for instances where residents are injured by a fire that resulted from an unsafe condition with that property. Liability could also extend to product manufacturers. When a lithium-ion battery catches fire, New York product liability law focuses on whether the battery, charger, or device was defective. Manufacturers, distributors, and retailers can be held strictly liable when a defect in a product they placed into the stream of commerce was a substantial factor in causing injury. Several sources of legal responsibility could come into play with these types of accidents.Battery Defects: Battery manufacturers could be responsible if the batteries involved lacked protective circuitry that led to thermal runaway.Retail Sellers: Retailers and online marketplaces that sell dangerous products or batteries could also share some level of responsibility.Inadequate Warnings: A manufacturer of e-scooters and other devices that use lithium batteries could be responsible if they failed to use adequate warnings.Building Safety: A building owner may bear liability if the unit lacked functional smoke alarms or self-closing fire-rated doors in certain situations.Fires remain a leading cause of preventable injury and death across New York City.
