Liability For Menands Dump Truck Accidents
Dump trucks pose a number of unique hazards for pedestrians. They are much heavier than passenger vehicles. Even a low impact collision could be catastrophic. According to the Engineering News-Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” There are many factors that could contribute to a dump truck accident.
- Dump truck drivers are often asked to work long hours and may naturally become fatigued.
- Dump trucks have large blind spots that can obscure the presence of pedestrians.
- Dump trucks take much longer to stop than passenger vehicles.
Dump truck drivers must get a commercial license and are expected to exercise a great deal of caution to avoid collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a dump truck driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of dump truck accidents tend to suffer very serious injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
If a dump truck driver was working at the time of a collision, their employer could be held at fault. Generally speaking, companies are liable for the wrongful actions of their employees – insofar as those employees were working within the course and scope of their job duties. The family of any person that died in a dump truck collision may have legal recourse through a wrongful death claim.
