Liability In Lewiston Bicycle Accidents
Thousands of people are killed or seriously injured every year in bicycle accidents. According to the CDC, “Nearly 1,000 bicyclists die and over 130,000 are injured in crashes that occur on roads in the United States every year. Adolescents, teens, and young adults have the highest rates of bicycle-related injuries treated in emergency departments (EDs). People ages 10-24 account for nearly one-third of all bicycle-related injuries seen in US EDs.” There are many steps that drivers can take to avoid hitting bicyclists.
- Drivers should always scan the road ahead of them for potential hazards.
- Drivers should maintain a safe speed at all times.
- Drivers should abstain from alcohol and other intoxicating substances.
All drivers have a legal obligation to exercise due care to avoid pedestrians, bicyclists and domestic animals in the roadway. If the driver of a vehicle fails to reduce their speed and hits a pedestrian, this could form the basis of a negligence claim. If the driver flees the scene of any collision that causes bodily injury or death, they could also face criminal charges. The family of any bicyclist killed in a car accident may be able to seek aid through a wrongful death claim.
