Liability For Brooklyn Dump Truck Accidents
Dump trucks pose a number of unique hazards for pedestrians. They are much heavier than passenger vehicles. Even a low impact collision could be catastrophic. According to the Engineering News-Record, “Dump truck accidents severe enough that the vehicle had to be towed away rose 9%, hitting 8,206 in 2016, the latest year statistics are available.” There are many factors that could contribute to a dump truck accident.
- Dump trucks have large blind spots that can obscure the presence of smaller vehicles and pedestrians.
- Dump trucks have a high ground clearance that can lead to people being sucked underneath the truck.
- Dump truck drivers are often asked to work at odd hours when pedestrians may be less visible.
All drivers must do everything that they can to avoid hitting pedestrians and bicyclists. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals in the roadway. If a dump truck driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim. Victims of dump truck accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Spinal cord injuries
Dump truck accidents are typically very complex events. In many situations, the dump truck driver involved was either distracted or traveling at an unsafe speed. If a dump truck driver was working at the time of a collision, their employer could be held at fault.
