BROOKLYN, NEW YORK (December 28, 2021)  – A nanny identified as Arcellie Muschamp was critically injured in a car accident at Union Street in Park Slope.

New York City police officials are saying that the collision took place around 8:00 a.m. on Sunday. Arcellie Muschamp was crossing the street when she was hit by a Dodge Ram pickup truck making a left turn.

Witnesses are saying that she was hit while saving the child she was taking care of.  She pushed the stroller out of the way before it could be hit.

A full investigation remains ongoing at this time.

Liability In Brooklyn Pedestrian Accidents

Pedestrians are uniquely vulnerable in collisions. They lack the protection of enclosed vehicles and are more likely to be overlooked. According to one report from the New York City Department of Transportation, “Pedestrians are 10 times more likely to die than a motor vehicle occupant in the event of a crash. Serious pedestrian crashes are about two-thirds deadlier on major street corridors than on smaller local streets.” There are numerous factors that could potentially contribute to a pedestrian accident:

  • Speeding
  • Inclement weather
  • Driver fatigue
  • Dangerous left turns

All drivers must exercise due care in order to avoid hitting pedestrians. According to New York Vehicle & Traffic Law § 1146(a), drivers must yield the right of way to pedestrians, bicyclists and domestic animals in the roadway. Many collisions take place when drivers make dangerous left turns and fail to check their blind spots. Depending on the specific facts of any case, liability could extend beyond any driver.

If a pickup truck driver was working at the time of a collision, the company that they were working for could be held at fault. Many pickup trucks are used for business in areas like construction, moving and landscaping. Generally speaking, companies are liable for the negligent actions of their employees – insofar as the tortious conduct was reasonably foreseeable. There are a number of steps that should be taken after any pedestrian accident.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Eye witnesses should be interviewed.
  • The driver that hit the pedestrian should be interviewed.

Any person that is injured in a pedestrian accident may be able to seek damages through a bodily injury claim. Damages can include lost wages, medical bills and pain and suffering. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are. There are, however, statute of limitations associated with civil claims. Failing to act within the statute of limitations may result in a permanent forfeiture of your rights.
