Liability In Brooklyn School Bus Accidents
Thousands of people are seriously injured or killed in bicycle accidents every year in New York City. According to one report by the People Powered Movement, “In 2019, the five boroughs saw 18,510 collisions involving cyclists – 18,494 causing injury and 16 [fatalities]. Despite the fact that the city was under a lockdown for most of 2020, there were still 12,450 bike crashes in 2020.” Despite the fact that the city has taken extensive measures to protect pedestrians, these numbers remain far too high. There are a number of steps that cyclists can take in order to better protect themselves.
- Always remain alert while riding a bicycle.
- Wear a helmet and other protective gear if you can.
- Cross the street only at marked intersections.
- Wear bright reflective clothing to increase your visibility.
School buses are typically extremely safe for passengers, but they pose a number of unique hazards to pedestrians. Due to their large size, school buses have large blind spots. Many collisions take place due to bus drivers that make dangerous turns in the roadway without checking their blind spots. Bus drivers are held to a high standard and must get a commercial driver’s license. If they are negligent and cause an accident, they could be held at fault through a civil claim.
Every bus driver must use caution while driving and take steps to avoid hitting bicyclists. Pursuant to New York Vehicle & Traffic Law § 1142 (b), all drivers must yield to pedestrians that are on the same road that they are traveling down. Drivers must also yield to pedestrians that are in marked crosswalks under New York Vehicle & Traffic Law § 1151. Depending on the specific facts of any case, liability for a school bus accident could extend beyond any driver.
The company or school district that owned a bus could potentially be liable for the negligent actions of a bus driver. Generally speaking, companies are liable for the negligent actions of their employees – insofar as the tortious conduct was reasonably foreseeable and a natural consequence of the worker’s job duties. It is extremely important to determine if a bus driver was working at the time of the crash. There are a number of other items that should be investigated.
- Was the bus driver distracted?
- Were they intoxicated?
- Did they receive adequate training?
- Does the intersection where the collision took place have a history of collisions.
The family of any bicyclist that died in a Brooklyn school bus accident may be able to seek justice through a wrongful death claim. Damages in a civil claim can help cover many of the unexpected expenses that often come with the sudden and tragic loss of a love one. Sadly, though, school districts will often fight hard to deny liability for accidents and stonewall plaintiffs. A New York City school bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
