Liability In Watertown Car Accidents
Thousands of pedestrians are killed or seriously injured in car accidents every year. According to the Centers for Disease Control, “Adults aged 65 years and older accounted for about 17% of the U.S. population in 2020. However, people ages 65 and older accounted for 20% of all pedestrian deaths in 2020.” There are a number of factors that could potentially contribute to a pedestrian crash.
- Drunk driving
- Inclement weather
- Driver distraction
All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must yield the right of way to pedestrians crossing in a lawfully marked crosswalk. The family of any pedestrian that died in a pedestrian accident may have legal recourse through a wrongful death claim. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
