Liability In Staten Island Fall Accidents

Falls are one of the leading causes of serious injury and death in the construction industry. According to PHP Systems/Design, “Within the construction industry overall, falls from roofs account for one-third of all fall-related fatalities. Nearly 40% of all fatalities in the construction industry for 2014 were from falls. In 2014, there were 647 fatal falls to a lower level. Of those, 340 involved falls [were] from 20 feet or less.” There are a number of steps that companies should take in order to protect workers from falls.

  • Workers should be given personal fall arrest systems (PFAS) when working 6 feet above the ground.
  • Workers should be given adequate training to stay safe on the job.
  • Guardrails should be installed in certain locations.

Building owners and general contractors are strictly liable for gravity related accidents under New York Labor Law 240.  This includes instances when a worker falls or is struck by a falling object. Construction owners and contractors must provide scaffolds and other safety measures to protect workers from falls. Failure to provide this could form the basis of a legal claim. Victims of falls tend to suffer very serious injuries including:

  • Broken bones
  • Spinal cord injuries
  • Lacerations
  • Organ damage
  • PTSD

The family of any victim that died in a workplace fall may have legal recourse through a wrongful death claim. Damages in a civil claim can help cover lost wages, medical bills and funeral expenses. It is extremely important that evidence is properly preserved after an accident. A wrongful death attorney can examine all of the facts of your case and let you know what your legal options are.
