Alexander Bolton Killed In Albany Shooting At The Lounge Nightclub

ALBANY COUNTY, NEW YORK (October 12, 2021) – A man from New Bedford, Massachusetts identified as Alexander Bolton has tragically died and six people were injured in an Albany club shooting at The Lounge on North Lake Avenue.

Albany County police officials are saying that the shooting took place on Saturday, October 9th. For reasons that remain under investigation there was a shooting just outside of the club.

Alexander Bolton was listed as one of the victims. He was transported to the Albany Medical Center and later died due to the severity of his injuries.

Six other people between the ages of 25 and 42 were also shot and had to be treated. Police officials have determined that there was probably an illegal club operating at the facility where the shooting took place.

The city’s codes department has been examining the building where The Lounge shooting took place for over a year. More than one cease and desist letter has been issued to the property.

A full investigation into the fatal nightclub shooting that killed Alexander Bolton remains ongoing at this time.

Liability In Albany Club Shootings

The United States has one of the highest instances of gun violence among developed nations. According to one report from Reader’s Digest, “In 2020, there were 610—nearly two mass shootings per day—killing 513 people and injuring 2,543. But mass shootings represent a tiny fragment of the problem. Nearly 20,000 people were murdered by guns last year, and another 40,000 injured.” The number of people killed by guns every year is actually higher than the number of people killed in car accidents. There are many measures that have been proposed to help curb gun violence.

The pandemic has changed the world as we know it. On a more local level, it has altered how people in New York socialize with one another. Laws and regulations were put in place which forced many clubs to shut down. In New York City, for example, indoor or outdoor gatherings of 10 or more people were not allowed. Just to stay afloat (or to have fun), many property owners began hosting illegal nightclubs. These nightclubs raise a number of security concerns totally apart from Covid-19.

Property owners could be liable for a shooting or assault that takes place on their property. Property owners in New York must take reasonable measures to protect guests from violent criminal activity. For example, security guards, cameras and adequate lighting can all work to reduce crime. The level of security that any property might need will depend largely on the history of crime in the area and the history of crime at any property. Properties in high crime areas will typically need more security than low-crime / low-risk areas.  When a property owner fails to take reasonable steps to protect guests they can be held liable through a negligent security claim.

A city could potentially be liable for a shooting if they failed to shut down an illegal club. A similar case in Albany, Georgia was litigated for nearly 10 years. A young man lost his life after he was shot at an illegal venue in 2010. Parents for the victim hired an attorney and brought a negligence claim against the city for failing to shut down the illegal club. Ultimately, however, the Georgia Supreme Court denied certiorari and thus did not hear the case. There are a number of steps that should be taken after any nightclub shooting.

  • City records of cease and desist orders should be examined.
  • A full and thorough investigation into the shooting should be conducted.

Investigating An Albany Club Shooting
