Liability For Bronx Garbage Truck Accidents

Garbage trucks are far more common than many people realize. According to one report from the Federal Motor Carrier Safety Administration (FMCSA), there are around 2,500 garbage truck fatalities every year. Garbage trucks have large blind spots that can obscure the presence of pedestrians. A fully loaded garbage truck can weigh as much as 50,000 lbs. Even a low impact collision can be catastrophic. There are a number of factors that could contribute to a garbage truck accident.

  • Dimly lit roadways
  • Excessive speed
  • Inclement weather
  • Vehicle system failures
  • Driver inattention

Bus drivers are considered common carriers and their drivers are held to a high standard in terms of safety. Many collisions are due to drivers that fail to operate their vehicle at a safe speed. Pursuant to New York Vehicle Code 1180, no person shall drive their vehicle at a speed greater than what would be reasonable or safe given the prevailing conditions of the road. If any driver fails to slow down to avoid a collision, this could form the basis of a negligence claim. It is important that evidence is preserved after any collision.

  • Eye witnesses should be interviewed.
  • Medical records should be collected.
  • Surveillance footage should be sought.
  • Work records for all commercial drivers involved should be reviewed.

Depending on the facts of any case, a city could potentially be liable for a collision if it was caused by a dangerous condition on public property. A city could also be liable if they owned the commercial vehicle involved in any collision. Generally speaking, companies are liable for the wrongful acts of their employees – insofar as those employees were working within the course and scope of their job duties. Any person that is injured in a MTA bus accident may have legal recourse through a civil claim.
