GLK Reaches $12 Million Settlement with New York City for Pelham Bay Landfill Toxic Tort Lawsuit

In the early 1990s, eight toxic tort lawsuits were filed against the City of New York alleging that the toxic substances emitting from the Pelham Bay Landfill caused the plaintiff’s childhood leukemia. The Gersowitz Libo & Korek firm was retained as trial counsel approximately 18 months ago. On July 26, 2013, after more than 22 years, the City of New York agreed to pay $12 million to settle the lawsuits. Honorable Justices Douglas McKeon and Larry S. Schachner played a pivotal role in reaching the settlement. Justice Schachner even requested for both the plaintiffs’ attorneys and the City’s attorneys to meet in his courtroom every day for more than two week until a resolution or an impasse was reached. Without his help, the case would have more than likely led to a lengthy trial.

Facts of the Pelham Bay Landfill Toxic Tort Lawsuit

In early 1990, neighborhood residents learned that in the mid to late 1970s an employee of the City of New York Department of Sanitation had permitted waste hauling companies to dump about one million gallons of toxic waste into the Pelham Bay Landfill, operated and owned by the City of New York, in the Bronx.

The citizens started to document all of the illnesses plagued by the residents, especially leukemia in the children who lived closest in proximity to the Landfill. They also started to pressure City and State officials to investigate the Pelham Bay Landfill as a cause for the illnesses. They demanded for the site to be cleaned up to avoid further damage.

In 1991, the twelve plaintiffs filed the first of the eight lawsuits against the City of New York. Although the City’s lawyers attempted to contest and even dismiss the lawsuits, both the Bronx Supreme Court and the Appellate Division found that there was enough evidence to survive these summary judgment motions
